This privacy policy relates to customer prospects (meaning here anyone potentially interested in purchasing products and services from Quartix). If you are a Quartix customer, please review the customer privacy policy.

Quartix Inc, Privacy Policy

Quartix (which means here Quartix Inc) respects your privacy. All information you give us is held with the utmost care and security. The Quartix privacy policy explains how we collect and use your personal information.

Please take time to review this privacy policy as it sets out our privacy practices for www.quartix.com and tells you how your personal information will be treated by us. We do not sell, rent or loan any identifiable information regarding our customers (which means here users of Quartix Software and users of our website www.quartix.com) to any third party. Only in the circumstances described within this Privacy Policy would we share your information with any third party.

Use of information

Quartix will not collect any personal information about individuals except as set out in this privacy policy. Examples of the types of personal information we will collect are: name, company, postal address, email address, phone number, details of website, features and product usage, installation data and product commentary.

We (or our representatives) may use the personal information provided to us to:

  • process orders submitted by you;
  • customize the service we provide to you;
  • administrate or otherwise carry out our obligations in relation to any agreement you have with us;
  • verify your identity (e.g. if you participate in any promotions administered by us);
  • anticipate and resolve any problems with any goods or services supplied to you;
  • carry out market research and surveys and track sales data;
  • send you our newsletter, where this is requested by you;
  • track your engagement with us, including through our website, articles and newsletters;
  • understand how you use our products and services;
  • contact you by telephone and send you follow-up communications relating to your use of Quartix’s software promoted on our website; and
  • send you information about our other products and services.

We may collect any personal information provided by you to us through this website or via use of our products, or we may collect this information via one of our telephone operators or through your email or other communications with us. Certain information is collected automatically, as described later in the privacy policy.

We may also ask you for other optional information such as what sort of equipment/device/software you use and what other subjects interest you. If you choose to give us this information, we will use it to help us to provide you with the best possible service that is personalized to your needs and preferences.

Although we do not make it compulsory to give us every item of information we ask for, the more information volunteered by our customers (and the more accurate it is), the better we can match our services to the needs of our customers.

We also collect information from you if you choose to take part in any of our website surveys or promotions. We will use this information to administer the promotion, help us to plan other promotions and improve the services we provide.

Third-Parties and their sites

Certain Quartix services, such as assisting with user evaluation of our products, are offered in conjunction with our (third-party) business partners. In such cases, we may need to share your personal information with them in order to provide these services. In this instance, please note that certain services may be unavailable to you, if you do not want to disclose the personal information you were asked for. In some cases, we may ask for anonymous feedback from you via a third party, in order to help us improve our service, we will fully respect your privacy and only if you waive your anonymity; we will be able to contact you about the feedback.

We may also share information with our representatives to send you information or contact you by telephone about our services and offers that we deem would be of interest to you.

Where our services make use of hosted tools provided by third parties the processing of personal data by those third parties is covered by data processing terms to maintain privacy and security of personal data.  Quartix remains liable if a sub-processor fails to meet their data processing obligations, subject to the liability cap in Quartix’s standard set of terms and conditions. 

Whilst we choose our business partners carefully, we are not responsible for their privacy policies and practices or those of other sites that you access using links from our site. Therefore, we recommend that you check the policy of each site you visit and ask anyone who contacts you if you have any concerns.

In addition, if you linked to our site from a third-party site, we are not responsible for the privacy policies and practices of the owners or operators of that third party site and recommend that you check the policy of that third party site and contact its owner or operator if you have any concerns or questions.

Log files/IP addresses

When you visit our website, we automatically log your IP address which is recognised by our web server. We use IP addresses to help us administer the website, to collect broad demographic information for aggregate use and to track your engagement with us.

Non-personal information

Quartix may share non-personal aggregate or summary information regarding its customers with partners or other third parties, such as information relating to the number of users linking to our website from their sites. Quartix does not sell or share any information at the individual level.

Cookies

Cookies are very small text files which are used to store data as you move around a website: your login details, what language preferences, etc. They are created by the website and sit in your browser until they expire.

There are three types of cookies: Session cookies, First-party persistent cookies and Third-party persistent cookies.

Session cookies only exist in temporary memory and are deleted when you close the browser. Any cookie which does not have an explicit expiry date is automatically set as a session cookie. They are only used by the website that created them during your current visit.

First-party persistent cookies are written onto your device’s memory and come with an expiration date. They are only used by the website that created them – during both your current visit and also future visits – and are generally used for functionality enhancements.

Third-party persistent cookies, also known as Tracking cookies, are also stored in your device’s memory and have a set expiration date. However, they can be retrieved by third-party services and used to build a profile of viewing habits and to show targeted advertisements. 

We have classified the cookies that we use on the site into three categories, Essential, Legitimate Interest and Analytics, based on how they are used.

Essential cookies are required to use the site without disruption. These cookies are either Session cookies and First-party persistent cookies, as defined above.

Quartix uses this type of cookie to remember your country, so that we don’t have to check this every time you reload a page. We also use them to remember that you’ve been shown the site selector, so that you’re not shown this every time you visit the site.

Legitimate Interest cookies store anonymous data for us to determine how you found our website. They do not contain any personal data and can not be used to identify anybody.

Analytics cookies are not essential to use the site but will provide us with additional data to enhance your experience of our website and our offering as a whole. These cookies are Third-party persistent cookies, as defined above.

Quartix uses this type of cookie to assess the effectiveness of our website content, our marketing campaigns and to build a profile of our customers as they use our services. We also sometimes use these cookies to display advertisements related to sites you have visited and limit the number of times a particular advert is shown.

These cookies do not allow us to personally identify you and will remain on your device until you delete them manually or automatically.

OPT-OUT

We allow users to opt out from all Analytics cookies, should they wish to do so. To change your cookie preferences, access your settings using the icon in the bottom left corner of every screen.

We do not allow users to opt-out of Essential cookies as this would make our site unusable.

Information about our products and services

It is very important to us that we provide you with the highest level of service. In order to help us do this, from time to time Quartix or its representatives may send you, with your consent, details of our products and services which we think may be of interest to you. If at any time you do not wish to continue to receive these details, then send an email message to [email protected]. You can also unsubscribe from our newsletter by using the ‘unsubscribe’ option located at the bottom of each of our newsletter communications. All you need to do is to click on the ‘Unsubscribe from our emails’ link.

YOUR RIGHT OF ACCESS AND TO LIMIT DATA USE

You have the right to access personal data we hold about you and we aim to keep our information as accurate as possible. If you would like to review or change the details you have supplied us with, please contact [email protected].  You can also request removal of your information from our records.

Individuals may have the right to limit the use and disclosure of their personal information as required by the Privacy Framework’s Principles, such as whether your personal information is disclosed to a third party or used for purposes materially different from the purpose for which the personal information was originally collected or subsequently authorized by you. Security

We have implemented technology and policies to safeguard your privacy from unauthorized access and improper use. For example, our website is encrypted. We will continue to monitor and update security measures as new technology and privacy regulations becomes available as appropriate to the website.

By using our website, or giving us your details at a trade events or exhibitions, you consent to the collection and use of this information by Quartix. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we would disclose it.

CALIFORNIA CONSUMER PRIVACY ACT

The California Consumer Privacy Act (CCPA) gives California residents certain rights, including the ability to request access to, and deletion of the information certain types of companies collect about you. Although we believe it to be exempt, Quartix Inc seeks to comply with the CCPA. The information Quartix collects about you will depend on the interactions which either you or your organisation have with Quartix. Examples of the information that we collect and the Business or Commercial Purposes for the use of this information are given in the “USE OF INFORMATION” section of this privacy policy.

The categories of personal information we collect are listed below. The categories of information will depend on the interactions which either you or your organisation have with Quartix and therefore only certain categories of information will be collected in each case. Furthermore, not all of these categories will have significant data associated with them; for clarity, we have highlighted the categories where data is predominantly captured.

Identifiers, protected classifications, commercial (e.g. products or services purchased), biometric (e.g. driving style), internet and network activity (e.g. usage of our website and some details of the network used), geolocation data, certain information from the category of audio, electronic, visual, thermal, olfactory or similar information, professional and employment-related information (e.g. your role, your job title), education information, inferences.

Under the CCPA, California residents have the following rights.

  • Right to access: the right to request access to certain pieces of personal information that we have collected about you.
  • Right to delete: the right to request deletion of personal information that we have collected about you. The CCPA also lists certain exemptions where we will not be required to delete data, such as where we are collecting this data to provide a service or where we have a legal obligation to hold the data.
  • Right of disclosure: the right to request disclosure of the categories and sources of personal information, as well as the business and commercial purposes of collecting this information. The “THIRD PARTIES AND THEIR SITES” section of this privacy policy sets out the limited circumstances in which we share information with third parties.
  • Right to opt-out and opt-in to the sale of personal information: we do not sell, rent or loan any identifiable information regarding our customers (which means here users of Quartix Software and users of our website www.quartix.com) to any third party.
  • Right to non-discrimination: the right to request information about any financial incentives which we offer you. We will not discriminate against you in any for exercising this or any other of the aforementioned rights. We reserve the right to run verification exercises to ensure adequate protection of information and will be unable to release data if requests are not verifiable to our full satisfaction.

PARTICIPATION IN EU-US AND SWISS-US Data PRIVACY Framework

Quartix Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.  Quartix Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.  Quartix Inc. has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit Data privacy framework website.

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Quartix Inc commits to resolve DPF Principles-related complaints about our collection and use of your personal information.  EU and UK and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF should first contact Quartix Inc at: [email protected] or alternatively, see the section ‘Contacting us’ below.

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Quartix Inc commits to cooperate and comply {respectively} with the advice of the panel established by the EU data protection authorities (DPAs) and the UK Information Commissioner’s Office (ICO) and the Gibraltar Regulatory Authority (GRA) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF.

The Federal Trade Commission has jurisdiction over Quartix Inc’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).  An individual has the possibility, under certain conditions, to invoke binding arbitration for complaints regarding Data Privacy Framework compliance not resolved by any of the other Data Privacy Framework mechanisms, for additional information see : https://www.dataprivacyframework.gov/framework-article/ANNEX-I-introduction.

Quartix Inc will maintain the confidentiality of personal data and does not plan for any onward transfer to third parties.  Should any onward transfer occur Quartix Inc will remain liable under the DPF Principles if the third party processes such personal information in a manner inconsistent with the DPF Principles, unless the Quartix Inc proves that it is not responsible for the event giving rise to the damage.  Quartix Inc may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
